Terms of Service with Privacy Policy and Cookies Policy

These Regulations specify the terms and conditions for the provision of services by CIEPIELA TECHNOLOGY PROMOTION SPÓŁKA Z OGRANICZONA ODPOWIEDZIALNOSCIA KRÓLOWEJ MARYSIENKI, nr 19, loc. 134, loc. WARSAW, code 02-954, hereinafter referred to as the CTP of electronic services at www.ciepiela.eu.
Legal basis of these regulations:
Telecommunications Law: the Act of 16 July 2004 Telecommunications Law (Journal of Laws 2014.243 as amended);
Shude Act: the Act of 18 July 2002 on the provision of electronic services (Journal of Laws 2013.1422 as amended);
Rodo Act: Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and the content of Article 13(1) and (2)
ODO Act: the Act of 24 May 2018 on the protection of personal data (Journal of Laws 2018, item 1000 as amended).

§ 1 General provisions and use of the Service

All rights to the Website, including property copyrights, intellectual property rights to its name, its Internet domain, as well as to templates, forms, logotypes placed on the Website (except for logotypes and photos presented on the Website for the purpose of presenting goods, the copyrights to which belong to third parties) belong to CTP, and the use of them may be performed only in the manner specified and in accordance with the Regulations and with the consent of the Seller expressed in writing.

CTP will endeavor to make the use of the Site possible for Internet users using all popular Internet browsers, operating systems, device types and Internet connection types. The minimum technical requirements for using the Site are a web browser with at least Internet Explorer 11 or Chrome 39 or FireFox 34 or Opera 26 or Safari 5 or later, with Javascript enabled, accepting cookies, and an Internet connection of at least 256 kbit/s. The Store's website is optimized for a minimum screen resolution of 1024x768 pixels

CTP uses a mechanism of "cookies" files that are saved by the Seller's server on the hard drive of the Client's end device while the Clients use the Shop's Website. The use of cookies is aimed at proper operation of the Website on the Clients' end devices. This mechanism does not damage the Client's terminal equipment and does not cause any configuration changes in the Client's terminal equipment or in the software installed on such equipment. Each Client can disable the "cookies" mechanism in the web browser of his/her end device. To do so, please go to the options Help / Settings / Privacy and Security in your browser. CTP points out, however, that disabling cookies may make it difficult or impossible to use the Site.
The Site uses the following cookies:
a/ Session cookies to obtain information about logged in users
b/ Google Analytics cookies - version of Universal Analytics monitoring activity and behavior of site visitors
c/ Google maps cookies.
d/ Cookie saving information about acceptance of cookie notification.
e/ FB pixels enabling logging in via FB

In order to use the services provided electronically through the Website, it is necessary for the Customer to have an active e-mail account.

It is forbidden for the Client to provide unlawful content and to use the Site, the Website or free of charge services provided by CTP in a way that is contrary to the law, morality or violates personal interests of third parties.

CTP declares that the public nature of the Internet and the use of services provided electronically may be related to the risk of unauthorized persons obtaining and modifying the Clients' data; therefore, the Clients should use appropriate technical measures to minimize the aforementioned risk. In particular, they should use anti-virus and identity protection software. CTP shall never ask the Client for the Password in any form.

§ 2 Free Services

CTP provides the following free-of-charge services to its Clients by electronic means
a) enabling access to the content on the Site
b) Contact
c) Customer Account
The services specified in paragraph 1 above are provided 7 days a week, 24 hours a day.
The Contact service is available to customers who wish to send a message/question to CTP and who have filled in the required information for that purpose, whereby the e-mail address and the content of the question are obligatory. The answer to the question shall be sent immediately to the provided e-mail address. The Customer's Account service is operated by the Log in tab designed for Companies. The tab allows a Customer with an Account to access the content not available to non-logged-in Customers. In order to create an account the customer shall provide his personal data such as: e-mail address, name and surname, telephone, company name, its address, NIP(tax) number. Without these data a customer account will not be created. When creating an account, the customer sets his own password, which allows him to log in. The account is activated after verification of the customer's e-mail address.
The service may be used by persons over 18 years of age.
The customer enters into an agreement for the provision of electronic services when entering the website.
The agreement terminates at the moment of leaving the Service or/and liquidation of the Customer's Account.

§ 3 Personal Data Protection

Purpose, basis of personal data processing and storage time:
conclusion and performance of the contract - (legal basis: Article 6 act 1 b RODO - performance of the contract) for the duration of the contract and settlements after its completion, performing legal obligations incumbent on us (legal basis: art.6 act.1c RODO - legal obligation) e.g. issuing and storing accounting documents, processing claims for the time when regulations require storing documents e.g. tax regulations,asserting claims (legal basis: art.6 act.1 f RODO- legally justified interest of the Administrator) - for the period in which claims arising from the contract become statute-barred, to create analysis, statistics for internal needs of the Administrator (legal basis: art.6 act 1 f RODO- legally justified interest of the Administrator) for a period of 5 years direct marketing (legal basis: art.6 act.1 f RODO - legally justified interest of the Administrator) for a period of 5 years, or in case of consent to direct marketing until its withdrawal respond to customer inquiries (legal basis: Article 6.1.b RODO - performance of a contract) for a period of 5 years for other purposes on the basis of the person's consent (legal basis: Article 6 act 1 a RODO - consent of the person) for the period specified in the information / regulations when obtaining consent.

Type and method of data acquisition we acquire only the data necessary for the purpose of processing. The provision of personal data is voluntary. However, failure to provide data may result in inability to use a particular service or to conclude a contract.
If in order to process the data for a particular purpose your consent is necessary, e.g. for the purposes of promotional campaigns, competitions, sending commercial information by e-mail, you may withdraw your consent at any time by sending a request to the e-mail address given in point 2. 2 or by following the instructions for granting consent.

Transfer of data
We transfer personal data to processors on our behalf: those operating our IT system, those providing hosting contracts,
subcontractors supporting the Administrator in the processes of operating the business (accounting companies, consulting companies, auditing companies, companies supporting administrative and technical processes, law firms, companies servicing receivables), delivery companies, payment processing companies - banks, payment institutions.

Rights of persons whose data we process (Art. 16-21 RODO)
You have the right to submit a request (by mail, e-mail - address in point 2) for rectification of data erasure of data - the right to be forgotten limitation of data processing - suspension of processing or no deletion of data access to the data - information about the processed data and a copy of the data data portability (to the extent specified in Art. 20 RODO) right to object - e.g. to processing for direct marketing purposes. Submitting such a request means that we will not process your data for this purpose.

You have the right to lodge a complaint with the President of the Data Protection Authority if you believe that the processing of your personal data violates the law.

CTP will protect the personal data provided to it and will use its best efforts to prevent unauthorized access or use.

§ 4 Final Provisions

The content of these Regulations can be saved by printing, saving on a disk or downloading from the Website at any time.

CTP reserves the right to amend these Regulations. Amendments to the Regulations shall come into force within 7 days from the date of their publication on the Site. If the Customer does not accept the new content of the Regulations, he/she is obliged to notify CTP of this fact, which results in termination of the contract in accordance with the provisions of §3 of the Regulations.

The Regulations shall come into force on 25.10.2019r.
